Two Person Kayak Policies

🚣‍♂️ Silver Tree Marine — Kayak Rental Agreement

✅ 1. Cancellation Policy

• ❗ Cancel 10+ days before your pickup date = Full refund

• ❌ Cancel within 10 days = No refund

• 🌧️ No exceptions for weather, illness, or change of plans. This is strictly enforced.

📍 2. Pickup & Return

• All kayaks must be picked up and returned in person at Silver Tree Marine.

• 🕓 Return time will be assigned at check-out.

• You must return the kayak to the same location by your assigned time.

🧰 3. Equipment & Safety

Your kayak rental includes:

• 🛶 Single Kayak = 1 Paddle + 1 Life Jacket (PFD)

• 🛶 Tandem Kayak = 2 Paddles + 2 Life Jackets (PFDs)

Important safety rules:

• 👥 All users must be able to swim and wear a life jacket at all times.

• 🌅 No use after sunset. Kayaks are not equipped for night-time use.

• ⚖️ Balance your load front-to-back and side-to-side to avoid capsizing.

• 📝 Signed waiver is required before any rental use.

👶 4. Child Safety

• 👧 Children under 13 years must wear a life jacket at all times.

• 🧒 Children under 5 years require a PFD with a headrest and leg strap.

• 📏 Life Jacket Sizes:

  • Under 30 lbs

  • 30–50 lbs

  • 50–90 lbs

  • 90+ lbs = Adult-size PFD

🌊 5. Lake Navigation Rules (Deep Creek Lake)

Follow these essential rules:

• 🚫 Stay 100 feet away from docks, boats, shorelines, bridges, and buoys.

• 🧭 Buoy Guide:

  • 🔵 Keep Right Buoys = Safe bridge passage (stay to the right).

  • 🔶 Orange Diamonds = Danger (rocks, stumps, shallow water).

  • 🟠 Slow/No Wake Zones = Paddle slowly. No wakes allowed.

⏰ 6. Late Return Fees

• 🕓 Kayaks returned late will be charged $50 per 30 minutes.

• 🪢 Even with dock staff help, you are responsible for securing the kayak properly.

⚠️ 7. Damage & Responsibility

You are 100% responsible for any damage to:

• 🛶 Kayak hull (cracks, holes, scrapes)

• 🪢 Paddle

• 🎽 Life Jacket (PFD)

Examples of chargeable damage:

• Dragging over rocks or docks

• Broken, lost, or mishandled gear

• Improper storage

📌 Even if dock staff assist you, you are liable for any damage during or after their help.

🔧 8. Breakdowns & Emergencies

If something goes wrong:

• Call Dock Staff: (301) 387-3345 (seasonal)

• Call Main Office: (301) 387-5855

We’ll assist as soon as possible.

❌ Damage caused by improper use (e.g., dragging over rocks) may result in additional charges.
❌ No refunds will be issued for standard repair times.

⚖️ 9. Legal Terms

• If part of this agreement is unenforceable, the rest still applies.

• Any legal disputes will be settled in Garrett County, Maryland, under state law.

✍️ 10. Acknowledgment & Liability Release

By signing below, you agree that:

• 📖 You’ve read and understood all terms.

• 🚣‍♀️ You understand the risks of kayaking (capsizing, injury, weather exposure).

• 💵 You are financially responsible for all damage or lost gear.

• 💬 You agree to wear a life jacket at all times.

• 🛡️ You release Silver Tree Marine and its staff from all liability due to injury, death, or property damage—even if caused by negligence.
